Draft — pending legal review

This policy is a baseline draft. A licensed US attorney must review and approve it before the platform processes payments or onboards paying customers. Any tenant using this platform should also confirm with their own counsel before relying on this language.

FIXIT Appliance Repairman(“we”, “us”, “our”) operates this website and the appliance repair services described on it. This Privacy Policy explains what personal information we collect from you, how we use and share it, and the choices you have about your information. By using our services or this website, you agree to the collection and use of information consistent with this policy.

1. Information We Collect

We collect information you provide directly when you:

  • Submit a service request (name, phone number, email address, service address, appliance details, problem description, photos you upload)
  • Communicate with us (call recordings, SMS, email, chat)
  • Make a payment (payment card data is collected and processed by our payment processor; we do not store full card numbers)
  • Sign service authorizations or warranties (signature, date, identification you provide)

We also automatically collect:

  • Device and usage data (IP address, browser type, pages visited, referrer URL, timestamps)
  • Cookies and similar technologies (see Section 7)
  • Approximate location derived from your IP or service address

2. How We Use Your Information

  • Schedule, dispatch, and complete the repair you requested
  • Communicate with you about your service (confirmations, technician arrival updates, follow-up, warranty)
  • Process payments and issue receipts/invoices
  • Maintain records required by law (tax, warranty, contractor licensing)
  • Improve our services and the website
  • Send marketing communications, only with your consent and only to email/SMS where you have opted in (you can opt out at any time — see Section 5)
  • Detect and prevent fraud, security incidents, and abuse
  • Comply with legal obligations and enforce our agreements

3. How We Share Your Information

We share your information only as follows:

  • Service technicians: Field technicians who perform your repair receive your name, phone number, service address, appliance details, and problem description so they can complete the job. Independent (1099) technicians are contractually bound to handle your information confidentially.
  • Payment processors: Card payments are processed by Stripe, Inc. Stripe's privacy policy applies to their processing of your card data.
  • Communication providers: SMS messages are delivered via Twilio, Inc. Voice/AI calls (where applicable) are routed through Vapi, Inc.
  • Hosting and infrastructure: Our service runs on infrastructure providers (Vultr, Cloudflare). These providers do not access your data except as necessary to operate the infrastructure.
  • Legal compliance: We may disclose information when required by law, subpoena, court order, or to protect rights, property, or safety.
  • Business transfers: In a merger, acquisition, or sale, your information may transfer to the successor entity, subject to this policy.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising as defined under the California Consumer Privacy Act (CCPA/CPRA).

4. SMS & TCPA Notice

By providing your phone number and checking the SMS consent box on our booking form, you give your prior express written consent (under the federal Telephone Consumer Protection Act) to receive service-related SMS messages from FIXIT Appliance Repairmanat the number you provided. Messages may include booking confirmations, technician arrival updates, reminders, and post-service follow-up.

Message and data rates may apply. Message frequency varies based on your service activity. Reply STOP at any time to opt out of all SMS from us; reply HELP for assistance. Your consent to receive SMS is not a condition of any purchase.

5. Email Marketing & CAN-SPAM

We may send you transactional emails (booking confirmations, receipts) regardless of marketing preferences. Marketing emails are sent only if you have explicitly opted in. Every marketing email includes an unsubscribe link; clicking it removes you from our marketing list within 10 business days, as required by the federal CAN-SPAM Act.

6. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what categories of personal information we collect, the sources, and how we use and share it

  • Not be discriminated against for exercising these rights

To exercise these rights, email us at privacy@example.com or call +18556520494. We will verify your identity (typically by matching the contact info you provide against our records) before fulfilling the request and will respond within 45 days.

7. Cookies & Tracking Technologies

We use cookies and similar technologies to operate the website (essential cookies) and, where you consent, to measure traffic and effectiveness of advertising. The specific tracking technologies in use depend on the configuration chosen by the shop providing service to you, and may include:

  • Google Analytics (traffic measurement)
  • Google Ads conversion tags (attribution of bookings to ad clicks, only when the shop runs Google Ads)
  • Meta (Facebook) Pixel (ad measurement, only when the shop runs Meta ads)
  • Microsoft Clarity (session recordings of how the website is used; PII is masked)

You can control non-essential cookies through your browser settings or our cookie consent banner. Essential cookies cannot be disabled without breaking core site functionality.

8. Data Retention

We retain your personal information for as long as necessary to provide services, comply with legal obligations (typically 4–7 years for tax, warranty, and contractor-licensing records), resolve disputes, and enforce our agreements. After the retention period, we securely delete or anonymize the data.

9. Children's Privacy (COPPA)

Our services are intended for adults (age 18 and over) who own or rent appliances requiring repair. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it promptly. Contact us if you believe a child has provided us information.

10. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit (TLS), encryption at rest for sensitive fields, access controls, and audit logging. No method of transmission or storage is perfectly secure; if we discover a breach affecting your information, we will notify you and applicable authorities as required by law.
